PRIVACY POLICY

Beyond Barriers Labs, Inc. (“Beyond Barriers,” “we,” “our,” and/or “us”) values the privacy of individuals who use our application, websites, and related services (collectively, our “Services”). This privacy policy (the “Privacy Policy”) explains how we collect, use, and disclose information from users of our Services (“users”, “you”, and/or “your”). 

We may offer our Services to individual customers that purchase our products and use our Services (“Individual Customers”), and to business customers that purchase our products and use our Services (“Business Customers”). In this Privacy Policy, individuals who register to use our products and Services to receive and engage in talent and career guidance are referred to as “Members”. 

By using our Services, you agree to the collection, use, disclosure, and procedures this Privacy Policy describes. Beyond the Privacy Policy, your use of our Services is also subject to our Terms of Service (https://www.gobeyondbarriers.com/terms-conditions). In this Privacy Policy, “personal information” means any information relating to an identified or identifiable individual.

In some cases, we need to collect your personal information to provide you with our Services. In these cases, if you choose not to provide the requested information, you may not be able to use our Services. We will tell you if providing your personal information is required by law or under a contract and what are the consequences of failing to provide it.

Personal Information We Collect

We collect a variety of personal information from or about you or your devices from various sources, as described below.

A. Personal Information You Provide to Us

Communications. If you contact us directly, we collect information about you, such as your first and last name, email, phone number, company name, job title, the number of employees of your company, information about the employee dynamic related to the group of people you intend to use our Service for, and other information you choose to provide. When you schedule a demo, we collect your first and last name, email address, phone number, company name, job title, and the contents of a message or attachments that you may send to us. If you join our waitlist, we may collect your first and last name, job title, company name, email address, phone number, information about your years of corporate experience, and information about the employee dynamic related to the group of people you intend to use our Service for. If you subscribe to our newsletter, podcast, product updates or to receive other news then we will collect certain information from you, such as your first and last name, email address, company name and phone number. When we send you emails, we may track whether you open them to learn how to deliver a better customer experience and improve our Services.

Individual Customer Information. When you apply to use our Services as an Individual Customer, we collect your first and last name, job title, company name, email address, phone number, and information about the employee dynamic related to the group of people who will use our Service (“Individual Contact Information”). After adding in your Individual Contact Information, you may be sent an email to confirm your participation to become a Member of our Services and to complete your purchase of our Services. If you choose to complete your registration, you will receive an invitation to download the Beyond Barriers application. Once you download the application and fill out the Member Registration and Account Information, you will become a Member of our Services.

Business Customer Information. When you purchase our Services as a Business Customer (or representative employee), we collect business contact information, such as your first and last name, job title, company name, email address, phone number, and information about the employee dynamic related to the group of people who will use our Service (“Business Contact Information”). After adding in your Business Contact Information, you can choose to provide us the names of employees who will be sent an email invitation to download the Beyond Barriers application, which is included in our Services. If your employees choose to complete their Member Registration and Account Information, they will become Members of our Services.

Member Registration and Account Information. When you register to use our Service as a Member, we ask you for your first and last name, email address, phone number, time zone, job title, company name, years of work experience, and your job industry. To the extent permitted by applicable law, you can choose to add additional information, such as your race and ethnicity, or gender. You may choose to provide information for your bio, including your current employment, prior employment history, and a profile photo. If you choose to link your LinkedIn profile to your Beyond Barriers’ account, we will also receive information from your LinkedIn profile, such as your employment history. We will also ask you to fill out an initial assessment questionnaire to get personalized insights about their career fitness and capabilities. When you fill out the questionnaire, we will collect your employer name or unique employer code and your personal opinions evaluating your career goals and capabilities. To the extent permitted by applicable law, you can choose to also provide your age, gender, sexual orientation, race and ethnicity, and location information (i.e., city, continent) when you fill out our questionnaire.

Careers. If you decide that you wish to apply for a job with us, you may submit your contact information and your resume online. We will collect the information you choose to provide on your resume, such as your education and employment experience.  You may also apply through online platforms, such as LinkedIn and Indeed. If you do so, we will collect the information you make available to us on LinkedIn.

Payment Information. If you make a purchase through our Services, our third-party payment processors collect your payment-related information, such as credit card information, billing address or other financial information. 

Questionnaires. Users of our Services may fill out an assessment questionnaire to get personalized insights about career fitness and capabilities. We will collect your first and last name, job title, company name, employer name or unique employer code, and your personal opinions evaluating your career goals and capabilities. To the extent permitted by applicable law, you can choose to also provide your age, gender, sexual orientation, race and ethnicity, and location (i.e., city, continent) when you fill out our questionnaire. We may ask Members to fill out other assessment questionnaires to benchmark their progress during the use of our Services.

Testimonials. If you choose to submit a testimonial to our website, we may ask you for and publicly post your statement, your first and last name, your job title, the name of your employer, and any information provided in your submitted testimonial.

User Feedback. Members may rate and review the Beyond Barriers Services or their Beyond Barriers facilitators. We receive information about ratings and reviews and give Beyond Barriers facilitators information about their ratings and reviews.


B. Personal Information We Collect When You Use Our Services. 

Location Information. We infer your general location information, for example by using your internet protocol (IP) address. 

Device Information. We receive information about the device and software you use to access our Services, including IP address, web browser type, operating system version, phone carrier and manufacturer, application installations, device identifiers, and push notification tokens. 

Usage Information. To help us understand how you use our Services and to help us improve them, we automatically receive information about your interactions with our Services, like the pages or other content you view, the searches you conduct, people you connect with and follow, the content you like, your comments, any content you post, the dates and times of your visits, your registration for courses, your registration for events, the courses you attend, and the events you attend.

Communication Between Users. You may use the Services to communicate with other Members. To provide the Services, we process information about these communications, such as the date and time of the message, and the content of the communications. For security purposes, we and third parties acting on our behalf may monitor and/or record these communications, to the extent permitted by applicable law.

Information from Cookies and Similar Technologies. We and our third-party partners collect information using cookies, pixel tags, or similar technologies ("Cookies"). Our third-party partners, such as analytics partners, may use these technologies to collect information about your online activities over time and across different services. Cookies are small text files containing a string of alphanumeric characters. We may use both session Cookies and persistent Cookies. A session Cookie disappears after you close your browser. A persistent Cookie remains after you close your browser and may be used by your browser on subsequent visits to our Services. Please review your web browser’s “Help” file to learn how you may modify your Cookie settings. Please note that if you delete or choose not to accept Cookies from the Service, you may not be able to utilize the features of the Service to their fullest potential.
 
C. Personal Information We Receive from Other Sources. 

Information from third-party services. If you choose to link our Services to a third-party account, we may receive information about you, including your profile information, your employment history, and your use of the third-party account. If you wish to limit the information available to us, you should visit the privacy settings of your third-party accounts to learn about your options. 

 

How We Use the Information We Collect

We use the personal information we collect:

  • To provide, maintain, improve, and enhance our Services;
  • To personalize your experience on our Services such as by providing tailored content and recommendations; 
  • To understand and analyze how you use our Services and develop new products, services, features, and functionality;
  • To communicate with you, provide you with updates and other information relating to our Services, provide information that you request, respond to comments and questions, and otherwise provide customer support;
  • To update your status on your social networks, to send messages on your behalf to your social networks, and to provide other features and services to you;
  • To facilitate the connection of third-party services or applications, such as social networks;
  • For marketing and advertising purposes, such as developing and providing promotional and advertising materials that may be relevant, valuable or otherwise of interest to you. If required by applicable law, we will only send you marketing communications with your consent;
  • To generate anonymized data containing only de-identified, non-personal information that we may use for any lawful purposes such as to publish reports;
  • To send you text messages and push notifications;
  • To process job applications; 
  • To create aggregated reports regarding use of the Services;
  • To facilitate transactions and payments;
  • To find and prevent fraud and abuse, and respond to trust and safety issues that may arise; 
  • For compliance purposes, including enforcing our Terms of Service or other legal rights, or as may be required by applicable laws and regulations or requested by any judicial process or governmental agency; and
  • For other purposes for which we provide specific notice at the time the information is collected.

Legal Bases for Processing European Personal Information

To the extent required by applicable law, if you are located in the European Economic Area (“EEA”), Switzerland or the United Kingdom (“UK”) (together “Europe”), we only process your personal information when we have a valid “legal basis,” including as set forth below.

  • Consent. You have consented to the use of your personal information. For example, where required by applicable law, we will only send you marketing communications with your consent.
  • Contractual Necessity. We need your personal information to provide you with our Services. For example, we may need to process your Personal information to respond to your inquiries or requests.
  • Compliance with a Legal Obligation. We have a legal obligation to use your personal information. For example, we may process your personal information to comply with tax, labor and accounting obligations.
  • Legitimate Interests. We or a third party have a legitimate interest in using your personal information. Specifically, we have a legitimate interest in using your personal information for product development and internal analytics purposes, and otherwise to improve the safety, security, and performance of our Services. We only rely on our or a third party’s legitimate interests to process your personal information when these interests are not overridden by your rights and interests.

How We Disclose the Personal Information We Collect

Vendors and Service Providers. We may disclose any personal information we receive to vendors and service providers retained in connection with the provision of our Services (e.g., data hosting providers). 

Business Customers. If employee Members register for our Services through a Business Customer, Business Customers may access or receive certain aggregated information associated with their employee Members’ use of the Services including whether the employee Members registered for a Beyond Barriers account, usage data, and assessment data. 

Third-Party App Integrations. If you connect a third-party application or web service to our Services, we may disclose personal information such as your name and email address to such third-party application or web service in order to make the connection.

User Content. Users can use our Services to find, enjoy, and share content. Any chats posted in your cohort group chat, including your name and biography, will always be viewable by other users. The content you post to the Services will be displayed on the Services and viewable by other users. We are not responsible for the other users' use of available information, so you should carefully consider whether and what to post or how you identify yourself on the Services.

Social Networks and Other Online Services. Our Services allow you to, upon your direction, disclose personal information to social networking services, such as LinkedIn. You understand and agree that the use of your personal information by any social networking websites will be governed by the privacy policies of these third-party platforms and your settings on that platform. We encourage you to review their privacy policies.

Analytics Partners. We use analytics services such as Google Analytics to collect and process certain analytics data. You can learn more about Google’s practices by visiting https://www.google.com/policies/privacy/partners/ and opt-out of them by downloading the Google Analytics opt-out browser add-on, available at https://tools.google.com/dlpage/gaoptout?hl=en. 
  
As Required By Law and Similar Disclosures. We may access, preserve, and disclose your personal information if we believe doing so is required or appropriate to: (a) comply with law enforcement requests and legal process, such as a court order or subpoena; (b) respond to your requests; or (c) protect your, our, or others’ rights, property, or safety. For the avoidance of doubt, the disclosure of your personal information may occur if you post any objectionable content on or through the Services.

Merger, Sale, or Other Asset Transfers. We may transfer your personal information to service providers, advisors, potential transactional partners, or other third parties in connection with the consideration, negotiation, or completion of a corporate transaction in which we are acquired by or merged with another company or we sell, liquidate, or transfer all or a portion of our assets. The use of your personal information following any of these events will be governed by the provisions of this Privacy Policy in effect at the time the applicable information was collected.

Consent. We may also disclose your personal information with your permission.

Your Rights and Choices

Sharing Preferences. We provide you with settings to allow you to set your sharing preferences for your account information on our Services. 

Marketing Communications. You can unsubscribe from our promotional emails via the link provided in the emails. Even if you opt-out of receiving promotional messages from us, you will continue to receive administrative messages from us.

Text Messages. If you wish to opt out of marketing text (SMS) messages from Beyond Barriers, you can email support@gobeyondbarriers.com or text the word “STOP” to the number from which you are receiving the messages. If you wish to opt out of all text messages from Beyond Barriers, you can email support@gobeyondbarriers.com or text the word “STOPALL” to the number from which you are receiving the messages, however you acknowledge that opting out of receiving all messages may impact your use of the service. You may continue to receive text messages for a short period while we process your request, including a message confirming the receipt of your opt-out request.

If you choose not to provide us with information we collect, some features of our Services may not work as intended.

Depending on the country in which you are located, you may have additional rights as described below: 

  • You may request access to the personal information we maintain about you, update and correct inaccuracies in your personal information, restrict or object to the processing of your personal information, have your personal information anonymized or deleted, as appropriate, or exercise your right to data portability to easily transfer your personal information to another company. In addition, you also have the right to lodge a complaint with a supervisory authority, including in your country of residence, place of work or where an incident took place.
  • You may withdraw any consent you previously provided to us regarding the processing of your personal information at any time and free of charge. We will apply your preferences going forward and this will not affect the lawfulness of the processing before you withdrew your consent.

You may exercise these rights by contacting us using the contact details as indicated in the “Contact Information” section below. Before fulfilling your request, we may ask you to provide reasonable information to verify your identity. There are exceptions and limitations to each of these rights.

Third Parties

Our Services may contain links to other websites, products, or services that we do not own or operate. We are not responsible for the privacy practices of these third parties. Please be aware that this Privacy Policy does not apply to your activities on these third-party services or any information you disclose to these third parties. We encourage you to read their privacy policies before providing any information to them.

Retention

We take measures to delete your personal information or keep it in a form that does not permit identifying you when your personal information is no longer necessary for the purposes for which we process it unless we are required by law to keep your personal information for a longer period. When determining the specific retention period, we consider various factors, such as the type of service provided to you, the nature and length of our relationship with you, and mandatory retention periods provided by law and the statute of limitations.

Security

We make reasonable efforts to protect your personal information by using physical and electronic safeguards designed to improve the security of the personal information we maintain. However, because no electronic transmission or storage of personal information can be entirely secure, we can make no guarantees as to the security or privacy of your personal information, to the extent permitted by applicable law.

Children’s Privacy

We do not knowingly collect, maintain, or use personal information from children under 16 years of age, and no part of our Services is directed to children. If you learn that a child has provided us with personal information in violation of this Privacy Policy, then you may alert us at support@gobeyondbarriers.com.

International Visitors

Our Services are hosted in the United States (“U.S.”). If you choose to use the Services from Europe or other regions of the world with laws governing data collection and use that may differ from U.S. law, then please note that your personal information is processed and stored in the U.S. We may also transfer your personal information from the U.S. to other countries or regions in connection with its storage and processing, fulfilling your requests, and operating the Services. By providing any information, including personal information, on or to the Services, you agree to such transfer, storage, and processing.

If you are located in Europe, we transfer your personal information outside of Europe to other countries for storage, fulfilling your requests, and operating the services, including to the U.S. Where required by applicable law, we apply appropriate protections when we transfer your personal information to such countries, including by transferring personal information to countries which have been found to provide adequate protection by the competent authorities as appropriate, using contractual protections for the transfer of personal information, or transferring personal information to recipients who have adopted binding corporate rules. Update Your Information

You can update your account information or close your account through your account settings.

Changes to this Privacy Policy

We will post any adjustments to the Privacy Policy on this page, and the revised version will be effective when it is posted. If we materially change the ways in which we use or disclose personal information previously collected from you through the Services, we will notify you through the Services, by email, or other communication.
